uz knjigu PRAVOSUDNA MEĐUNARODNA POMOĆ

Međunarodni pravni saobraćaj danas je intenzivniji nego ikad, jer olakšano prekogranično kretanja lica, roba i novca dovodi do zasnivanja brojnih i složenih pravnih odnosa sa elementom inostranosti koje domaći sudovi i drugi organi moraju da rešavaju.

Zato je važno da pravosudni organi budu blagovremeno, potpuno i pravilno upoznati sa međunarodnom pravnom regulativom koja predviđa pravosudnu saradnju država i proceduru pravne pomoći za brže i delotvornije rešavanje predmeta u građanskoj i krivičnoj materiji, bez obzira na različitost pravnih sistema i državne granice, što podrazumeva da pravosudni delatnici treba da budu dobro upoznati ne samo sa unutrašnjim zakonodavstvom već i sa međunarodnim konvencijama i drugim prihvaćenim međunarodnim dokumentima koji u današnjem vremenu dobijaju prioritet u primeni u odnosu na nacionalno zakonodavstvo.

Ova knjiga bavi se međunarodnom pravnom pomoći u širem smislu, sa ciljem da bude od koristi ne samo pravosudnim organima, već i domaćim i stranim, fizičkim i pravnim, licima kod razrešavanja određenih pitanja sa međunarodnim elementom. Polazeći od multilateralnih i bilateralnih međunarodnih ugovora, kao i domaćeg zakonskog režima, u oblasti građanskopravne pomoći, razmotrena su pitanja načina opštenja između država u proceduri međunarodne pravne pomoći, sastavljanje i sadržina zamolnica, postupanje po zamolnici, uskraćivanje pravne pomoći i njeni troškovi, zatim: slobodan pristup sudovima, aktorska kaucija, besplatna sudska pomoć, kolizione norme i nadležnost s međunarodnim elementom u oblasti braka, roditeljskog prava, usvojenja, starateljstva, izdržavanja, zaostavština i dr., prava stranih lica na nepokretnostima, te priznanje i izvršenje stranih sudskih odluka, kao i stranih arbitražnih odluka. U krivičnopravnoj oblasti, u knjizi su detaljno obrađeni forma, sadržina i jezik zamolnice za međunarodnu krivičnopravnu pomoć, način opštenja između sudova, zaštita svedoka ili veštaka, mogućnost uskraćivanja pravne pomoći i njeni troškovi, zatim, ekstradicija - izdavanje okrivljenih i osuđenih lica, transfer postupka - preuzimanje krivičnog gonjenja, kao i izvršenje stranih krivičnih presuda - transfer osuđenih lica iz jedne države u drugu. Poseban deo posvećen je međunarodnom pravosuđu gde su data objašnjenja o osnivanju, nadležnosti i postupku pred međunarodnim stalnim i ad hoc krivičnim sudovima, kao i pred Evropskim sudom u Strazburu. Takođe, jedan odeljak knjige bavi se pitanjima legalizacije isprava u međunarodnom pravnom saobraćaju, načinom i putevima saznanja i utvrđivanja stranog prava koje treba primeniti pred domaćim sudom, kao i pitanjima sudskog imuniteta stranih država i međunarodnih organizacija, kao i njihovih funkcionera i službenika.

Već navedena sadržina ove knjige upućuje na to da je za njeno razumevanje i korišćenje neophodno imati pri ruci relevantne pravosudne konvencije, kako multilateralne, tako i bilateralne, koje povezuju države i uređuju metode i mehanizme međunarodne pravne pomoći. Pregled naziva tih konvencija, ugovora, sporazuma, protokola i aranžmana dat je na kraju knjige. Knjiga sadrži i obrasce zamolnica i sudskih odluka koji se koriste u postupku međunarodne pravne pomoći, kao i registar pojmova, a uz to, priložen je prevod i dva novija međunarodna dokumenta koji se bave pitanjima međunarodne pravne pomoći - to su Sporazum o ekstradiciji i Sporazum o međusobnoj pravnoj pomoći, oba zaključena 2003. godine između Evropske unije i Sjedinjenih Američkih Država, u kojima se prožimaju elementi kako evropskog, tako i anglosaksonskog prava, što je aktuelno i za sve države nastale na području nekadašnje SFR Jugoslavije. u Beogradu, 10. oktobra 2005.godine

of the book ’’International legal assistance’’ 2005

Contemporary international legal traffic between the states, international organizations and institutions is very complex and diverse resulting from as very complex, delicate and different relations arising from the intense traffic of people, goods and capital regardless the state border lines. Numerous legal relations are established including the element of “abroad” to be resolved by domestic courts and other authorities required for that purpose to be familiar not only with the domestic legislature but also the applicable international bilateral and multilateral agreements and sometimes even with the regulations of other states.

It is the common fact that international law is becoming richer, more diverse and more complex on wide international level and regional and bilateral level as well. This requires the need of strenghtening institutional and human resources on the national level in order to develop and enhance international legal cooperation between the states, judicial assistance and protection of human freedom and rights and the state itself endangered by potential international terrorism, acts of organized crime, corruption and other criminal matters. It is eesential that the judicial authorities are fully, regularly and on time introduced to the international law and regulations that set out the judicial cooperation of the states and legal assistance procedure for faster and more efficient resolving of proceedings in civil and criminal matters. regardless of the diversities of the judicial systems and state frontiers, meaning that judicial staff should be properly introduced not only to the domestic legislation but also international conventions and other accepted international documents having today priority in application in relation to the national legislature.

This book deals with the international legal aid in a broader sense, intending to be useful not only to the judicial authorities but also to domestic and foreign natural and legal entities (persons) when resolving certain issues with “abroad” element. Starting with bilateral and multilateral international agreements and domestic legal regime in the area of civil legal assistance as well, the issues of communication between the states were considered in respect to the legal assistance procedure, completion and the contents of the pleas (applications), acting upon the application, refusal of legal assistance and the expences thereof, free access to the courts, actors bail, free of charge assistance of the court, collision norms and the jurisdiction including international element in the matrimonial area, parental right, adoption, gardianship, support, inheritance, etc. foreign persons rights on real estates, recognition and execution of foreign verdicts and foreign arbitrations as well. In a criminal law area, the book has thoroughly elaborated the form, contents and the language of the applications (pleas) for international criminal law assistance, way of communication between the courts, witness and expert protection, possibility of refusal of legal aid and the expences thereof, extradition, surrender of accused and convicted persons, conduct referral – taking over of the proceeding and execution of foreign rulings in criminal matters – transfer of convicted persons from one state to another. Specific part is dedicated to international judiciary with the explanations of the foundation, jurisdiction and procedure before the regular international and ad hoc courts, and Europian court in Strasbourg as well. In addition, a part of the book is dealng with the issues of legalization of documents in the international legal traffic, method and the ways of comprehending and determining the foreign law that should be applied before the domestic court and the issues regarding the judicial immunity of the foreign states and international organizations and their officials and.employees

The quoted contents of the book points to the fact that for its understanding and use it is necessary to have relevant judicial conventions both multilateral and bilateral relating the states and arranging the methods and mechnisms for international legal assistance. The survey of titles of conventions, agreements, treaties, prptocols and arrangements is attached at the end of the book. The book contains the forms of application (plea) and the verdicts in the legal assistance procedure and the glossary of terms as well. Besides, enclosed is the translation of two new international documents regarding the matters of international legal assistance – The Agreement on extradition and the Agreement on mutual legal assistance, both concluded in 2003 between European union and United States of America and bearing the mixture of European and Anglo- Saxon law, the actual fact for the states arosen in the area of former FR of Yugoslavia.
